Acceptable Use Policy:

  1. Introduction

    Van Zandt Internet supports the free flow of information and ideas over the Internet.
    Van Zandt Internet does not actively monitor, nor does Van Zandt Internet exercise editorial control over the content of any web site, electronic mail transmission, mailing list or other material created or accessible over Van Zandt Internet services.
    However, Van Zandt Internet reserves the right to remove any materials that, in Van Zandt Internet Services’ sole discretion, are potentially illegal, offensive, obscene, immoral, may subject Van Zandt Internet to liability, or violate this Acceptable Use Policy ("Policy").
    The violation of this Policy may result in the suspension or cancellation of your Van Zandt Internet services.
    This policy should be read in conjunction with the Van Zandt Internet’s Internet Terms of Use and Service Agreement.
     

  2. Policies

    The following are the terms and conditions of Van Zandt Internet Services’ Acceptable Use policy:
     
    1. Use of Van Zandt Internet Services' internet service constitutes acceptance of these Terms and Conditions
       
    2. Van Zandt Internet may only be used for lawful purposes.
      Transmission of any material in violation of any U.S. or state regulation is prohibited.
      This includes, but is not limited to: copyrighted material, material legally judged to be threatening or obscene, or material protected by trade secret.
      Customer agrees to indemnify and hold harmless Van Zandt Internet from any claims resulting from Customer's use of the service that damages Customer or another party.
       
    3. Service is payable in advance.
      Any Monthly account not paid by the 15th of the month in which it is due for services used may be suspended for non payment.
      Semi Annual and Annual accounts are due before the anniversary renewal date or may be suspended.
      Accounts not paid in full by noon of the last business day of the calendar month will be suspended.
       
      Suspended accounts will be charged a $15 reconnect fee and must be paid before being reconnected.
      Monthly service is automatically renewed each month unless canceled by Customer
      Accounts may be canceled in writing at any time with no penalty.
      Only a written request received to terminate service relieves Customer of the obligation to pay the monthly charge.
      Customer and Van Zandt Internet jointly agree that all requests to cancel service will be made in writing or via electronic email or fax.
      Service will terminate on the last day of the month prepaid unless earlier termination is requested by the customer.
      No refunds are given on terminated accounts. 

       
    4. Subscriber is responsible for all local and long distance charges for connecting to Van Zandt Internet Services' Internet service.
       
    5. Subscriber is responsible for all of Subscriber's account confidentiality of username and/or password(s).
      Van Zandt Internet will suspend access or change access to Subscriber's account(s) immediately upon Subscriber's notification or report to VZINet of a lost, stolen or compromised password.
       
    6. Using a personal account for high volume or commercial use is prohibited. 
      Activities that are prohibited as high volume include, but are not limited to:
    1. Any mailbox on the server exceeding 20MB will be locked as being over quota.
      An attempt will be made to notify the member at that time with further information. Van Zandt Internet reserves the right to delete mail or the mailbox from the server after this notification.
       
    2. Exceeding 10 MB of disk space for free Web sites (personal use only). Any free Web site exceeding 10 MB will be suspended until the customer brings the disk space usage under 10 MB. Or, additional megabytes may be purchased. These prices may be obtained by calling (903) 567-4482.  
       
    3. If you would like to receive high-volume or commercial services, please contact Van Zandt Internet at  (903) 567-4482 for information about establishing a commercial account.
    1. Using Van Zandt Internet for illegal purposes or in support of illegal activities is prohibited. In accordance with Section 5.ii.a of the Internet Access Agreement, Van Zandt Internet reserves the right to cooperate with legal authorities and/or injured third parties in the investigation of any suspected crime or civil wrong. Activities that are prohibited as potentially illegal include, but are not limited to:
    1. Unauthorized copying of copyrighted material including, but not limited to, digitization and distribution of photographs from magazines, books, or other copyrighted sources, and copyrighted software.
       
    2. Exporting software or technical information in violation of U.S. exports control laws.
       
    3. Posting or emailing of scams such as 'make-money-fast' schemes or 'pyramid/chain' letters.
       
    4. Threatening bodily harm or property damage to individuals or groups.
       
    5. Making fraudulent offers of products, items, or services originating from your account.
       
    6. Attempting to access the accounts of others, or attempting to penetrate security measures of Van Zandt Internet Services’ or other entities' systems ("hacking"), whether or not the intrusion results in corruption or loss of data.
       
    7. The unauthorized use of a person's name or likeness.
    1. Harassing others by 'mass-mailing' or 'mail-bombing'.
      'Mass-mailing' constitutes sending unsolicited email or 'spam' to multiple users. 
      'Mail-bombing' constitutes sending more than ten (10) similar mail messages to the same email address.
    1. Sending unsolicited electronic mail (email) messages including where the recipient objects to either the content of the message or to the receipt of the message in general is also prohibited under this Section.
       
    2. Members acknowledge that they are expressly prohibited from utilizing Van Zandt Internet Services’ equipment or any Van Zandt Internet Services’ email address in connection with the sending of the same or substantially similar unsolicited email message, whether commercial or not, to a large number of recipients.
      This prohibition extends to the sending of unsolicited mass mailings from another service which in any way implicates the use of Van Zandt Internet Services’ service, Van Zandt Internet Services’ equipment or any Van Zandt Internet Services’ email address(es).
       
    3. Member specifically agrees that he/she/it will not utilize the Van Zandt Internet service, Van Zandt Internet Services’ equipment or any Van Zandt Internet email address in connection with the transmission of the same or substantially similar unsolicited message to 50 or more recipients in a single day.
       
    4. Members responsible for these acts may be terminated at Van Zandt Internet Services’ discretion.
      For each day upon which this provision is violated, Member agrees to pay Van Zandt Internet $10.00 per day for an unintentional violation of this provision, but where warranted, such as in the case of an accidental transmission, Van Zandt Internet may waive all or part of the applicable charge.
      In cases of willful violations of this provision, Member agrees to pay Van Zandt Internet $200.00 per day. Van Zandt Internet, at its sole discretion, shall determine whether such a violation was unintentional or willful.
      Payment by member under this provision shall not prevent Van Zandt Internet from seeking to obtain other legal remedies against member, including other damages or an injunction.
    1. Revealing your account password or other confidential access information to others or allowing use of your account by others is prohibited.
    1. At no time, on a dial up account, can there be simultaneous use of the same Subscriber name and password combination.
      Simultaneous use of the same user name on multiple machines will result in the access name being locked from further access until the first day of the following calendar month.
       
    2. Forging any message header, in part or whole, of any electronic transmission, originating or passing through Van Zandt Internet services is prohibited.  
    1. Distributing viruses, Trojans, worms, backdoors, etc. to or from Van Zandt Internet systems is prohibited.
       
    2. Use of software or any device that would allow your account to stay logged on while you are not actively using Van Zandt Internet services or use the account for the purpose of operating a server of any type is prohibited. (See section 3 below)
       
    3. Installation of 'auto-responders', 'cancel-bots' or similar automated or manual routines which generate excessive amounts of net traffic, or disrupt email use by others is prohibited.
       
    4. Engaging in any of the above activities using the service of another provider but channeling such activities through a Van Zandt Internet account or re-mailer, or using a Van Zandt Internet account as a mail drop for responses is prohibited.
       
  3. Unlimited Service

    Member acknowledges that Van Zandt Internet Services’ internet service is intended for periodic, active use of email, file transfers via FTP, Internet chat, Internet games and browsing the World Wide Web, from one computer dialing in at a time.
    Member further agrees not to use the service on a standby or inactive basis in order to maintain a connection.
    Pinging is expressly prohibited.
    Accordingly, Van Zandt Internet maintains the right to terminate member’s connection following any extended period or inactivity as determined by Van Zandt Internet Services.
    Unlimited service does not mean always on connectivity.
    Access names or user names, not to be confused with Access Account or User Account, are limited to 150 hours of logged in time per calendar month.  After 150 hours of time has been detected by the system, an additional access name or user name will be assigned at no additional charge.
     
  4. Van Zandt Internet Assumes No Liability

    Van Zandt Internet has no practical ability to restrict conduct, communications or content which might violate this Policy prior to its transmission on Van Zandt Internet Services’ systems, nor can Van Zandt Internet ensure prompt removal of any such communications or content after transmission or posting. Accordingly, Van Zandt Internet does not assume liability to subscribers or others for any failure to enforce the terms of this Policy.
     
  5. Revisions to this Policy

    Van Zandt Internet reserves the right to modify this Policy at any time.
    Notice of modifications to this Policy may be given to subscribers by posting such changes to the Van Zandt Internet homepage (http://www.VZINet.com), to these policy pages,  by electronic mail, or by conventional mail.
